A BOC-3 is filed by an agent who accepts legal documents on behalf of the company. Only the designated agent can file the document. The document is then posted online. Brokers and freight forwarders do not need to use this service because they are allowed to file the document themselves.
When filing the BOC-3 online, you must include the full name and address of the carrier, the person authorized to sign and title, the name of the SOP Agent, and the street address for the states, listed individually or a blank designation. Blank designations are used when the company is acting as an agent for another company or association.
A broker or freight forwarder’s application should contain the following information: name, address, telephone number, e-mail address, and signature. There should be an indication of whether the broker or freight forwarder is filing the application on behalf of another party. For example, if a broker or freight forwarder represents a shipper, the broker or freight forwarder must indicate that he/she represents the shipper.
Also, there should be an indication of what state the broker or freight forwarder is authorized to represent. This information should be included on the first page of the application.
A person who is authorized by law to receive service of legal process on behalf of another person or entity may do so by delivering a copy of the legal process to him or her personally, or to the individual or business entity whose name appears on the legal process.
A person who operates as an individual must file a separate application with each state in which he or she conducts business. A blanket certificate is used when operating within a group of states. Changes in designation must be filed with the FMCSA.

If ten or more business days have gone by since the grant date, and you haven’t yet received the operating authorization document, you can contact the FMC.
You can also check whether your operating authority has been issued using the FMC’s Licensing and Insurance website. Your BOC-3 needs to be refiled if you want to do any changes such as changing your name, transferring your authority, or reinstating your motor carrier operating authority.
